The offer and sale of products on the www.magh-ecommerce.it site are governed by these General Conditions of Sale. Access to and use of this website presuppose the reading, knowledge and acceptance of these General Conditions of Sale as well as the Privacy Policy and the Additional Legal Notes.

1. How to conclude the contract with the Seller

1.1 To conclude the purchase contract for one or more products on www.magh-ecommerce.it you must be of legal age; you must fill in all the mandatory fields of the order form available in electronic format and transmit it to the Seller, electronically, following the relative instructions.

1.2 The order form contains a reference to the General Conditions of Sale, a summary of information on the essential characteristics of each product ordered, the relative price as well as information on the means of payment that you can use to purchase each product, on the delivery methods and on the shipping costs of the products purchased.

1.3 The contract is concluded when the Seller receives your order form electronically.

1.4 Before proceeding with the purchase of the products, by sending the order form, you will be asked to carefully read the General Conditions of Sale.

1.5 The order form will be archived in our database for the period of time necessary to process orders and in any case in accordance with the law.

1.6 Before submitting the order form, you will also be asked to identify and correct any data entry errors.

1.7 The language available to conclude the contract with the Seller is Italian and English.

1.8 Once the contract is concluded, the Seller will take charge of your purchase order.

1.9 The Seller may not process your purchase orders which are incomplete or incorrect or in the event of unavailability of the products. In these cases, we will inform you by e-mail that the contract is not concluded and that the Seller has not followed up on your purchase order specifying the reasons. If the products presented on www.magh-ecommerce.it are no longer available or on sale at the time of your last access to the site or when sending the order form, the Seller will promptly notify you of the unavailability of the ordered products. In case of forwarding of the order form and payment of the price, the Seller will refund the amount already paid by you.

1.10 With the electronic transmission of the order form, you unconditionally accept and undertake to observe, in relations with the Seller, these General Conditions of Sale. If you do not share some of the terms set out in the General Conditions of Sale, please do not submit the order form for the purchase of products on www.magh-ecommerce.it.

1.11 By submitting the order form you confirm that you know and accept the General Conditions of Sale and the additional information contained in www.magh-ecommerce.it, also referred to via links, including the Privacy Policy and Additional Legal Notes.

1.12 Once the contract is concluded, the Seller will send you, by e-mail, a receipt of the purchase order, containing the information already contained in the order form (refer to the General Conditions of Sale , information relating to the essential characteristics of the product, detailed indication of the price, means of payment and delivery costs).


2. Guarantees and indication of product prices

2.1 On www.magh-ecommerce.it products from various countries of the world are offered for sale but in any case conform to EEC standards respecting the quality standards in force.

2.2 The Seller does not sell irregular products or products of inferior quality to the corresponding standards offered on the market.

2.3 The essential characteristics of the products are presented on www.magh-ecommerce.it inside each product sheet. However, the images and colors of the products offered for sale on www.magh-ecommerce.it may not correspond to the real ones due to the effect of the Internet browser and the monitor used.

2.4 The displayed price is inclusive of VAT. Delivery costs will instead be added separately. Product prices may be subject to updates. Make sure of the final sale price before submitting the relevant order form.

2.5 In the event of exercising your right of withdrawal, the Seller has the right not to accept the return of products that have been altered in their essential and qualitative characteristics or that have been damaged.


3. Payments

3.1 To pay the price of the products and the relative shipping costs, you can use one of the methods indicated in the Payments and proposals section of the order form.

3.2 If you choose to pay through the Pay-Pal system your financial data will not be shared with www.magh-ecommerce.it but will be managed directly by PayPal. Your privacy is protected and your financial and personal information will be protected through the use of advanced automatic encryption systems.

3.3 In the event that the customer does not collect the goods purchased on delivery, you will be charged for the costs of shipping, storage, return of shipping to the MAGH Elettronica S.N.C. equal to € 35 or more in the case of bulky parcels or multiple consignments, in addition to the costs of managing the practice of the debt collection agency (only in the event of non-payment of the expenses after a reminder by MAGH Elettronica S.N.C.). We remind you that at the time of purchase, the customer enters into MAGH Elettronica S.N.C. a sales contract, which must be respected by both parties. In case of refusal of the ordered goods and failure to pay the costs, we will activate the debt collection agency, which will proceed by legal way with the formal collection of the amount due.



4. Shipping and delivery of products

Please pay attention to what is reported in this section because the indications contained therein form an integral and substantial part of these General Conditions of Sale and, therefore, are considered by you fully known and accepted at the time of transmission of the order form. < / p>

6. Right of withdrawal

6.1 You have the right to withdraw from the contract concluded with the Seller, replacing or making the purchased products, without any penalty and without specifying the reason, within fourteen (14) calendar days starting from the day of receipt of the purchased products.

6.2 To withdraw from the contract you must fill in the Return / exchange of goods form and send it promptly by registered mail to: "MAGH Elettronica SNC, Via Guglielmo Oberdan, 4, 42124 Reggio Emilia RE" . You will also need to attach a photocopy of this completed form together with the goods you will return.

6.3 The products must be returned to the Seller by delivering them within fourteen (14) days from the date of receipt of the purchased products.

6.4 The shipping costs for the registered mail and return of the purchased products will be borne by the buyer. For the return of the products you will have to use a forwarder of your trust, making personally the payment of the necessary expenses; Any responsibility in case of loss or damage of the products during transport, according to the methods and terms foreseen for exercising the right of withdrawal, will remain at your expense.

6.5 The Right of Withdrawal - in addition to compliance with the terms and conditions described in the previous points 6.1, 6.2, 6.3 and 6.4 - is understood to be exercised correctly if the following conditions are also fully respected: < / p>

- a copy of the Return Form must be sent together with the returned products;

- the products must not have been used, worn, washed or damaged;

- the identification tag must be returned together with the product;

- the products must be returned in their original packaging;

- returned products must be delivered to the shipper within fourteen (14) days from the date you received the products.

6.6 Shipping costs and cash on delivery expenses are not refunded in case of exchange or return of goods.

6.7 Returns and exchanges on customized products such as Converse and Levis, vintage garments, swimwear, tailored suits and on special products such as adhesive silicone bras, underwear and lingerie are not accepted. for hygiene reasons.

6.8 There are no exchanges and returns on products on sale with discounts greater than 50%.


7. Time and method of reimbursement

7.1 If the Right of Withdrawal is exercised following the methods and terms indicated in the previous paragraph 6, the Seller will reimburse the sums collected for the purchase of the products (excluding the costs of shipping) according to the methods and terms provided below.

7.2 Once the returned products have been received, the Seller carries out the necessary checks relating to their compliance with the conditions and terms indicated in paragraph 6 and, in the event that the checks are successfully concluded, the Seller will send you, by e-mail, the relative confirmation of acceptance of the products thus returned.

7.3 Only after the positive outcome of these checks, the Seller will reimburse the amounts paid in the shortest possible time and, in any case, within thirty (30) days from the date on which the Seller has communicated, by e-mail, the confirmation of acceptance of the returned products. If the methods and terms for exercising the right of withdrawal are not respected, as specified in paragraph 6 above, you will not be entitled to a refund of the sums paid to the Seller; in this case we will notify you that the products cannot be accepted and, if you wish, you can get back the products in their state in which they were returned to the Seller at your own expense. Otherwise, the Seller may retain the products, in addition to the amounts already paid for their purchase.

7.4 If there is no correspondence between the recipient of the products indicated in the order form and who made the payment of the sums due for their purchase, the refund of the sums will be made by the Seller, in any case, towards the person who made the payment.

7.5 The seller is not responsible for any delays in the reimbursement of the amounts paid, which are not dependent on his will, including delays caused by the credit / debit card management institutes.


8. Return and replacement for non-compliant goods

8.1 In the event that the products delivered do not comply with what is indicated in the order form (in terms of model, technical characteristics, size or color) you have the right to request replacement within fourteen (14) days from the day of receipt of the products; in this case the Seller will bear the shipping costs for returning the products and for their replacement.

8.2 To request the replacement of the products you must fill in the Return / exchange goods form and send it promptly to the email address: magh@magh.it.

8.3 Non-compliant products must be returned to us within fourteen (14) days from the day of receipt of the items, using only the courier that we will communicate to you.

8.4 In order for the Seller to be able to replace the products, the following conditions must also be fully respected:

- a copy of the Return Form must be sent together with the returned products;

- the products must not have been used, worn, washed or damaged;

- the identification tag must be returned together with the product (if present at the time of receipt of the goods);

- the products must be returned in their original packaging;

- returned products must be delivered to the shipper within fourteen (14) days from the date you received the products.

8.5 After returning the products, the Seller carries out the necessary checks relating to their compliance with the conditions and terms indicated in the previous points 8.1, 8.2, 8.3, 8.4 and, in the event that the checks are concluded positively, the Seller sends you, via e-mail, the relative confirmation of acceptance of the products thus returned.

8.6 Only after the positive outcome of these checks, the Seller will send you the replacement product. If the methods and terms specified in this paragraph 8 are not respected, you will not be entitled to the replacement of the product; in this case we will notify you that the products cannot be accepted and, if you wish, you can get back the products in their state in which they were returned to the Seller at your own expense. Otherwise, the Seller may retain the products, in addition to the amounts already paid for their purchase.


9. Applicable law and dispute resolution

The General Conditions of Sale are governed by Italian law and in particular by Legislative Decree 6 September 2005 n. 206, on the consumer code, with specific reference to the legislation on distance contracts and the legislative decree 9 April 2003 n. 70 on certain aspects of electronic commerce.

Online dispute resolution for consumers

The consumer residing in Europe must be aware of the fact that the European Commission has set up an online platform that provides an alternative dispute resolution tool. This tool can be used by the European consumer to resolve any dispute relating to and/or deriving from contracts for the sale of goods and services stipulated online. Consequently, if you are a European consumer, you can use this platform for the resolution of any dispute arising from the online contract entered into with the Owner.
